PRIVACY POLICY

1. INTRODUCTION DLW Concepts ("we", "us", "our") is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy applies regardless of our annual turnover, as we voluntarily comply with the APPs to maintain the highest standard of consumer trust, given we collect names, emails, and use analytics/tracking tools.
2. WHAT PERSONAL INFORMATION WE COLLECT We may collect: name, postal/site address, email address, telephone number, ABN/ACN, payment and billing details, project specifications, and technical data (IP address, browser type, device information, pages visited).
3. HOW WE COLLECT INFORMATIONDirectly from you via our website contact/quote forms, email, or phone.Automatically through cookies and analytics tools when you browse our website (see our separate Cookie clause below).From third parties such as lead-generation platforms (e.g., AirTasker) and referral partners.

We may disclose it to: subcontractors and suppliers engaged on your project; our accountant/bookkeeper and software providers (Xero, Google Workspace); professional advisers (legal, insurance); and government/regulatory bodies (QBCC, ATO) where required by law.
6. OVERSEAS DISCLOSURE Some of our third-party service providers (e.g., cloud storage or software providers) may store data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure such providers comply with the APPs or equivalent privacy standards.
7. DATA RETENTION We retain personal and transaction data for a minimum of seven (7) years to meet taxation (ATO) and building industry (QBCC) record-keeping obligations, after which it is securely destroyed or de-identified.
8. DATA BREACH NOTIFICATION In the event of an eligible data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme.
9. ACCESS AND CORRECTION You may request access to, or correction of, the personal information we hold about you at any time by contacting admin@dlwconcepts.com. We will respond within a reasonable timeframe, generally within 30 days.
10. COMPLAINTS If you believe we have breached your privacy rights, please contact us in writing. If you remain unsatisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

REFUND AND RETURNS POLICY

1. OUR COMMITMENT UNDER AUSTRALIAN CONSUMER LAW DLW Concepts is committed to full compliance with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Our goods and services come with guarantees that cannot be excluded. We do not, and will never, adopt a blanket "No Refunds" policy, as this is illegal under the ACL.
2. CONSUMER GUARANTEES Under the ACL, our goods must be of acceptable quality, fit for the purpose disclosed, and match any description or sample provided. Our services must be provided with due care and skill, be fit for any disclosed purpose, and be delivered within a reasonable time (where no completion date is fixed by contract).
3. MAJOR FAILURES Where there is a major failure with a service, you are entitled to cancel your service contract and receive a refund for the unused portion, or seek compensation for the reduced value of the service. For a major failure with goods, you may choose a refund or a replacement.
4. MINOR FAILURES Where a failure does not amount to a major failure, you are entitled to have the problem fixed within a reasonable time. If this is not done, you may arrange for a third party to fix the problem and recover reasonable costs from us, or cancel the contract and obtain a refund.
5. CUSTOM AND BESPOKE GOODS Given the nature of our bespoke cabinetry, custom furniture, and made-to-measure joinery, refunds or exchanges are not available where: you simply change your mind; you provided incorrect measurements or specifications; or the item was custom-manufactured to your exact order. This exclusion does not affect your rights under the ACL where goods are faulty, not fit for purpose, or do not match the agreed specification.
6. CONSTRUCTION AND CIVIL WORKS — STATUTORY WARRANTIES For domestic building work, DLW Concepts provides the statutory warranties mandated under Schedule 1B, Part 3 of the Queensland Building and Construction Commission Act 1991 (Qld) ("QBCC Act"), including warranties that: materials will be good and suitable for the purpose; work will be performed in an appropriate and skilful manner; and work will comply with all relevant laws, including the National Construction Code.
7. DEFECTS LIABILITY PERIOD Unless a longer period is specified in a formal QBCC contract, we provide a defects liability period of six (6) months from the date of practical completion for minor, non-structural defects. Structural defects are covered by the statutory warranty periods prescribed under the QBCC Act (currently up to 6 years and 6 months for structural defects in domestic building work).
8. HOW TO REQUEST A REFUND, REPAIR, OR REPLACEMENT To make a claim, please contact us at admin@dlwconcepts.com with your invoice/quote number, a description of the issue, and photographic evidence where applicable. We will respond within a reasonable timeframe and, where appropriate, arrange an inspection.
9. PROOF OF PURCHASE We recommend retaining your quote, invoice, and any contract documentation as proof of purchase for warranty and refund purposes.

SECURITY & DATA HANDLING DISCLOSURE

1. PURPOSE OF THIS DISCLOSURE In accordance with guidance published by Business Queensland regarding online consumer protection, this Security & Data Handling Disclosure informs you of the specific measures DLW Concepts takes to protect your personal, financial, and payment card information when you interact with our website or make a payment.

4. BANK TRANSFER (EFT) SECURITY Where payment is made via direct bank transfer (EFT), account details are provided directly on invoices issued through Xero's secure platform. We recommend clients verify bank details directly with us via a known phone number before transferring funds, as a precaution against invoice fraud and phishing scams.
5. DATA STORAGE SECURITY All digital client records, quotes, invoices, and project data are stored on encrypted, cloud-based platforms (Google Workspace and Xero), which employ industry-standard security certifications, encrypted data centers, and multi-factor authentication access controls.
6. ACCESS CONTROLS Access to client personal and financial information is restricted to authorized personnel on a need-to-know basis. All staff and subcontractors with system access are bound by confidentiality obligations.
7. DATA BREACH RESPONSE We maintain a data breach response procedure consistent with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). Should an eligible data breach occur, affected individuals and the OAIC will be notified without undue delay.
8. NO GUARANTEE OF ABSOLUTE SECURITY While we implement reasonable and industry-standard security measures, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but commit to promptly addressing any known vulnerabilities.
